There are some problems in the system of

 “Giving Staying Qualification before Applying Korean nationality”

September 4, 2012, The Ministry of Law announced that they would change the method of giving staying qualification and Korean nationality. But it hasn’t been made, yet. It’s just a plan of Ministry of Law.

Ministry of Law explains about this system, “If a foreigner wants to be a Korean, at first, he or she should get a permanent staying qualification and stay a certain period.

1. It is said that nationality law would be changed. If you want to apply to Korean nationality, you have to live at least for 3 years in Korea, among this period, more than 1 year should be state of permanent residence visa. It means that it takes 3 years for getting Korean nationality. Now, it takes 2 years.
2. It means that marriage migrants ought to pass 2 inspections, an examination for staying qualification of permanent residence, an examination for nationalization.
3. Although entering Korea, you are not given a staying qualification of permanent residence. Only if you pass Korean language test, you can get the staying qualification. However, the Ministry of Law hasn’t announced the exact practical method,, yet.
4. On entering Korea, marriage migrants are forced to study Korean language. Of course, you need to study Korean language in order to live in Korea. But is Korean language easy to learn? It may take 1 year or 3 years for you to pass the test for qualification of permanent residence. Nobody knows. If you fail the test, you can’t get the qualification. And if you don’t have the qualification, you can’t apply the nationalization.
5. If your Korean spouse doesn’t help you to get the permanent staying qualification, you can’t get even the qualification.
6. It is said that the qualification of permanent residence is renewed. But they don’t give any exact information whether you the qualification continuously or not, in case of divorce.

OUR CLAIMS 1.     We are opposed to lengthening the period from 2 years to 3 years.  2.     We object to a plan of Ministry of Law enforcing them to take a Korean language test. 3.     We are against the plan of the Ministry of Law which makes the marriage migrants who are in a hard situation more frustrating. 4.     We assert that marriage migrants can maintain a qualification staying of permanent residence even though after their divorce. 5.     Once getting a qualification staying of permanent residence, you have to renew every 7 years. The qualification should be given without any condition.
